I have always dreamed of becoming a lawyer. Back in 1997 when I finally got a chance to read a newspaper article about lady bar topnotcher whose last name is Fernandez from UP College of Law (which I saw from wikipedia her first name to be Cecilia), I got myself so engrossed to the idea that soon, I will make it to Law School. The circumstance of my life back then denied me that opportunity.

I just have to finally write it down here because in just a short while, I too will be hurdling that dreaded, most feared and known to be the hardest exam in the land - the Bar Exams. The year 1997 for lady bar top notchers was repeated the following year (please refer to my source for complete details) and this time from the Law School north of Manila, the University of the Cordilleras.

Priorities in life changed as I was already earning. Then I have to earn more so I could pursue my law school but there came a time that I thought I have to get a Master's degree first. Then ten years after, in 2007, I did what I thought was impossible. I enrolled in Law School and upon seeing my classmates, I knew it wasn't too late for me to try and survive the first semester... and I did. I barely survived it, especially the second semester. But fate had been kind so I passed all my subjects in my first year. Time seem to fly so fast and I suddenly realize that I am already in my fourth year. A little more step then I will soon be entering that Bar exam room. The thought gives me mixed emotions. Happy to have almost made it through law school but afraid to take a step further.

I am afraid but I am going to do whatever it takes and probably will have to drag myself beyond what I think to be my limits. I have so much dreams for myself, for my family, for my mother land. In the end, I would like to be singing one of my favorite David Cook songs at the American Idol "Time of my Life". That is the only song I can only hear right now and I would love to get that time of my life where I can finally see the letters ATTY before my name... God-willing!

Cordillera Regional Assembly Members vs. COMELEC
G.R. No 93054, December 4, 1990
FACTS:
On January 30, 1990, the people of the provinces of Benguet, Mountain Province, Ifugao, Abra and Kalinga Apayao and the City of Baguio cast their votes in a plebiscite hold pursuant to RA 6766. The creation of the Region was approved by the voters of the province of Ifugao but overwhelmingly rejected by the rest of the provinces and city mentioned.
ISSUE:
Whether or not the province of Ifugao can, alone, legally and validly constitute the Cordillera Autonomous Region?
Facts 1) COMELEC issued a resolution that the organic act 13 approved by the voters of Ifugao; secretary of justice reiterated in the memo to the constitute CAR and Exec. Sec. granted authority to wind up the affairs of the Cordillera Exec Board and Cordillera Regional Assembly created under EO 220.
RULING:
The sole province of Ifugao cannot validly constitute the Cordillera Autonomous Region… To become part of a region, it must join other provinces, cities, municipalities and geographical areas. It joins other units because of their common and distinctive historical and culturasl heritage, economic and social structures, other relevant characteristics. The constitutional requirements (Art. X section 15 of the 1987 Constitution) are not present.

On the due date of the check, Benjamin deposited it but it was dishonored. As despite demands, Mercedes failed to make good the check, Benjamin filed in January 2009 a complaint for collection of sum of money before the RTC of Davao.
Mercedes filed in February 2009 her Answer with Counterclaim, alleging that before the filing of the case, she and Benjamin had entered into a dacion en pago agreement in which her vintage P1,000,000 Rolex watch which was taken by Benjamin for sale on commission was applied to settle her indebtedness; and that she incurred expenses in defending what she termed a “frivolous lawsuit.” She accordingly prayed for P50,000 damages.

As Cicero was walking down a dark alley one midnight, he saw an “owner-type jeepney” approaching him. Sensing that the occupants of the vehicle were up to no good, he darted into a corner and ran. The police apprehended Cicero, frisked him and found a sachet of 0.09 gram of shabu tucked in his waist and a Swiss knife in his secret pocket, and detained him thereafter. Is the arrest and body-search legal? (3%)

Dominique was accused of committing a violation of the Human Security Act. He was detained incommunicado, deprived of sleep, and subjected to water torture. He later allegedly confessed his guilt via an affidavit.
After trial, he was acquitted on the ground that his confession was obtained through torture, hence, inadmissible as evidence.
In a subsequent criminal case for torture against those who deprived him of sleep and subjected him to water torture, Dominique was asked to testify and to, among other things, identify his above-said affidavit of confession. FACTS:
Pursuant to RA 7155, creating the Municipality of Tulay na Lupa in the province of Camarines Norte to be composed of Barangays Tulay-naLupa, Lugui, San Antonio, Mabilo I, Napaod, Bayan-bayn, Mataulang, Pag-asa, Maot, and Calabasa, all in the Municipalty of Labo, some province, COMELEC scheduled a plebiscite was conducted throughout the municipality of Labo and majority voted against the creation of the Municipality of Tulay-na-Lupa. Petitioner prayed that the plebiscite conducted to set aside with the contention that such plebiscite was a complete failure.
ISSUE:
Whether or not the plebiscite conducted in the areas comprising the proposed Municipality of Tulay na Lupa and the remaining areas of the mother Municipality of Labo is valid.
RULING:
COMELEC did not commit grave abuse of discretion and the result of the plebiscite rejecting the creation of the new municipality of Tulay-na-Lupa is valid.
It stands to reason that when the law states that the plebiscite shall be conducted “in the political units directly affected,” it means that residents of the political entity who would be economically dislocated by the separation of a portion thereof have a right to vote in said plebiscite. Evidently, what is contemplated by the phrase “political units directly affected” is the plurality of the political units which would participate in the plebiscite.

Basco et al vs. PAGCOR
G.R. No. 91649 May 14, 1991
FACTS:
PD 1869 is the charter which created the Philippine Amusement and Gaming Corporation. PAGCOR was created to enable the government to regulate and centralize all games of chance authorized by existing franchise or permitted by law. Section 13 par 2 of the decree exempts PAGCOR, franchise holder from paying any “tax of any kind or form, income or otherwise… whether national or local”. According to the petitioners, this waived the Manila City government’s right to impose taxes and license fees which is recognized by law.
ISSUE:
Whether or not the exemption clause of PD 1869 is violative of the principle of local autonomy?
RULING:
The city of Manila, being a municipal corporation has no inherent right to impose taxes. Its power to tax must always yield to a legislative act which is superior having been passed upon by the state which has the inherent power of the state to tax.
The court added that since one of the roles of PAGCOR is to regulate gambling casinos, this “places it in the category of an agency or instrumentality of the government…” PAGCOR should be and actually is exempted from local taxes, otherwise, its operation might be burdened, impeded, or subjected to control by a mere local government.
The matter of regulating, taxing or otherwise dealing with gambling is a state concern and hence, it is the sole prerogative of the state to retain it or delegate it to local government.

TAN vs. COMELEC
FACTS:
Pursuant to BP Blg 885, COMELEC scheduled a plebiscite on January 3, 1986 for the approval or repeal of a New Province in Negros: The plebiscite confined only to the inhabitants of the territory, namely: Cities of Silay, Cadiz and San Carlos and the municipalities of Calatrava, Taboso, Escalante, Sagay, Manapla, Victorias, E.B. Magalona and Don Salvador Benedicto. The voters from the rest of the province of Negros Occidental were excluded. The new province will comprise 4,019.95 sq km more or less but in fact only 2856 sq km where LGC requires 3,500 sq km as its territory.
RULING:
The court decided no. The use of the word territory in this particular provision of the LGC and on the very last sentence thereof, clearly reflects that “territory” as therein used, Las reference only to the mass of land area and excludes the waters over the political unit exercise control.
The distinction between “territory” and “land area” which respondents make in an artificial or strained construction of the disputed provision whereby the words of the statute are arrested from their plain and obvious meaning and made to bear an entirely different meaning to justify an absurd or unjust resuld.
It would be rather preposterous to maintain that a province with a small land area but which has a long, narrow, extended coast like (such as L.U) can be said to have a larger territory that a land-locked province (such as Ifugao or Benguet) whose land area manifestly exceeds the province first mentioned.

Respondents were lessees of a panel of land owned by Marta Reyes located at San Pascual St., Malate, Manila. After the demise of Marta, Victor Reyes, her son, inherited the land. Victor informed the respondents that they would have a right of first refusal to buy the land. In 1989, without the knowledge of respondents, the land was sold to petitioner Cynthia Ortega who was able to ultimately secure title to the property in her name.
On May 25, 1989, Cynthia Ortega filed petition for condemnation of the structures on the land. The office of building Official issued a resolution ordering the demolition of the houses of respondents on November 27, 1989. Copies were received by respondents on December 7, 1989 and on December 12, the day respondents filed an appeal contesting the order, petitioners proceeded with the demolition of the house.
Respondents filed case before Manila RTC which was dismissed. On appeal, CA reversed the decision and ordered petitioners to pay respondents for moral and exemplary damages and attorney’s fees.

ISSUE:

PILAPIL vs. IBAY SOMERA
FACTS:
On September 7, 1979, Imelda Manalaysay Pilapil, a Filipina and Erich Geiling were married at Friedenweiler in the Federal Republic of Germany. After about three and a half years of marriage, Geiling initiated a divorce proceeding against Pilapil in Germany in January 1983.
Pilapil, petitioner, on the other hand, filed an action for legal separation, support and separation of property before RTC of Manila on January 23, 1983 where it is still pending as a civil case. On January 15, 1986, the local Court of Germany promulgated a divorce decree on the ground of failure of marriage of the spouses. The custody of the child was granted to petitioner.
On June 27, 1986, private respondent filed two complaints for adultery alleging that, while still married to respondent, petitioner “had an affair with a certain William Chua as early as 1982 and with yet another man named Jesus Chua sometime in 1983. The respondent city fiscal approved a resolution directing the filing of two complaints for adultery against petitioner. Thereafter, petitioner filed a motion in both criminal cases to defer her arraignment and to suspend further proceedings thereon. Respondent judge merely reset the date of the arraignment but before such scheduled date, petitioner moved for the suspension of proceedings. On September 8, 1987, respondent judge denied the motion to quash and also directed the arraignment of both accused. Petitioner refused to be arraigned and thus charged with direct contempt and fined.”
ISSUE:
Whether or not the case for adultery should prosper.
RULING:
The petition entered dismissing the complaint in criminal case was upheld for lack of jurisdiction. The temporary restraining order issued in this case was made permanent. The law provides that in prosecutions for adultery and concubinage the person who can legally file the complaint should be the offended spouse. The fact that private respondent obtained a valid divorce in his country, is admitted. Private respondent, being no longer married to petitioner has no legal standing to commence the adultery case under the posture that he was the offended spouse at the time he filed suit.
